As long as it’s below 20 seconds it’s legal to put up as a sample, you won’t be allowed to put up entire length songs due to not paying royalty fees to the artists and production team whom put the songs out. The RIAA would shut you down asap the second they see you’re putting up whole songs on your site, especially for sale.

    You would need to be licensed in order to put up any copyrighted material for sale online or for download.

    To get this license you’d have to pay a sum and a % of every purchase I suppose, you would have to contact the RIAA for more information.

    Your hosting company would also shut you down the second they see copyrighted material posted for free or again, especially for sale.

    Make sure you get everything straightened out before you do so.

    However, if you stream songs (not make it capable for users to download, but to listen to freely online) is legal and you could do this by setting up a shoutcast radio server; more info at: http://www.shoutcast.com

  2. First of all, you would need to contact the record companys song that you are planing to share. You need permission from the record company itself. You might have to pay them a fee to put up the whole song or share songs. Samples don’t hurt b/c it’s not the whole song, but beware a lot of people is getting sue these days, not by the Law Enforcement agencys or whatever but by the record companys itself.
